1. Introduction and Scope
This Disclaimer applies to the websites operated by Aomark Digital LLC (“Aomark Digital,” “Company,” “we,” “us,” or “our”), including https://aomarkdigital.com/, https://aomark.io/ and https://link-building.rs/ (the “Websites”), to our Aomark and LinkBuilding platforms (the “Platforms”), to our WordPress plugins and other software (the “Software”), and to our digital marketing and technology services (the “Services”).
This Disclaimer forms part of, and should be read together with, our Terms of Service, Platform Terms of Use, Refund and Cancellation Policy and Privacy Policy. If there is a conflict between this Disclaimer and a signed or accepted Engagement Document, the Engagement Document prevails for that engagement. Nothing in this Disclaimer limits any rights you have under mandatory consumer protection laws.
2. General Information Only
The content published on our Websites, including blog posts, guides, resources, templates, checklists, frequently asked questions, case studies, newsletters and social media posts, is provided for general informational and educational purposes only. It is written for a general audience and does not take into account the specific circumstances, objectives or legal obligations of your business.
Although we aim to keep our content accurate and current, digital marketing practices, search engine guidelines, advertising platform policies, software and laws change frequently. Content may therefore become outdated, incomplete or inaccurate after publication. We make no representation or warranty that any content is accurate, complete, current or suitable for your purposes, and we are not obliged to update it. You should verify information independently before relying on it.
3. No Professional Advice
Aomark Digital is a digital marketing and technology company. We are not a law firm, accounting firm, financial adviser, tax adviser or healthcare provider. Nothing on our Websites, Platforms, Software or in our Services constitutes legal, tax, accounting, financial, investment, medical or other regulated professional advice.
- Legal and regulatory matters: where our content or Services refer to privacy laws, cookie consent, advertising rules, email marketing laws, accessibility standards, platform policies or other legal requirements, we do so for general awareness only. You are responsible for your own legal compliance and should consult a qualified lawyer in your jurisdiction.
- Industry-specific content: content that relates to regulated industries, such as healthcare, legal services, financial services or real estate, is about marketing those businesses. It is not professional advice in those fields, and businesses in regulated industries should confirm that their marketing complies with the rules that apply to them.
- Financial and tax matters: any discussion of budgets, costs, return on investment or business performance is general in nature and is not financial or tax advice.
Receiving information from our Websites, or contacting us, does not create a professional-client relationship of any kind other than a commercial relationship under our Terms of Service.
4. No Guarantee of Results
The results of digital marketing and technology work depend on many factors outside our control, including search engine algorithms, advertising auctions, market conditions, seasonality, competition, the quality, pricing and reputation of your products or services, your website, your sales process, user behavior and the actions of third parties. Accordingly:
- we do not guarantee any specific ranking position, organic traffic level, number of leads, conversion rate, sales volume, revenue, return on investment or return on advertising spend;
- we do not guarantee that search engines will index, rank or continue to rank any page, website or placement;
- we do not guarantee that any result achieved will be maintained over time;
- we do not guarantee any specific timeframe for achieving results; and
- past performance, including results for other clients, does not indicate or guarantee future results.
Any statement on our Websites or in our communications about improving visibility, growth, performance or results describes the objective of our work, not a promise of a specific outcome. Only commitments expressly set out in a signed or accepted Engagement Document are binding on us.
5. Search Engine and Platform Risk
Search engines, advertising platforms, social networks, email service providers and other third-party platforms are independent businesses that we do not control. They may, at any time and without notice:
- change their algorithms, ranking factors, policies, guidelines or terms;
- take manual or algorithmic action against websites, pages, links, advertising accounts or sending domains;
- reject, restrict or remove advertisements, content or accounts;
- change their pricing, auction dynamics, features, reporting or application programming interfaces; or
- suspend or terminate services.
Such changes may affect the visibility, performance or availability of your website, content, campaigns or accounts, positively or negatively. We are not responsible for any loss arising from these actions, although we will reasonably assist you within the scope of the Services we have agreed to provide.
6. Link Building Risk Disclosure
If you purchase link building or content placement Services from us, including through LinkBuilding, you acknowledge the following:
- Search engine policies. Google’s published spam policies state that buying or selling links for ranking purposes may be treated as link spam. Google and other search engines may ignore, devalue or take manual or algorithmic action in respect of links they consider to violate their policies, which may affect the rankings of the linked website.
- Independent decision. The decision to purchase placements is your own business decision, made with knowledge of these risks. We do not represent that any placement complies with the guidelines of any search engine or that it will not be ignored, devalued or penalized.
- Disclosures and attributes. Publishers may label content as sponsored or apply “nofollow,” “sponsored” or similar link attributes in accordance with their own policies or applicable law, including advertising disclosure requirements. We do not ask Publishers to remove legally required disclosures.
- Independent Publishers. Placements are published on websites owned and controlled by independent Publishers. We do not control their editorial decisions, content, other links, technical condition, indexing status, traffic or continued operation.
- No guarantee of impact. We do not guarantee that any placement will be indexed, pass ranking value, generate referral traffic, improve rankings or remain live beyond the Replacement Period described in our Refund and Cancellation Policy.
- No liability for penalties. To the maximum extent permitted by law, we are not liable for any ranking loss, traffic loss, manual action, penalty, de-indexing or other consequence resulting from placements or from search engine evaluation of links to your website.
7. Paid Advertising
Advertising platforms such as Google and Meta control ad approvals, auctions, pricing, delivery, targeting availability, reporting and account enforcement. We do not guarantee ad approval, account standing, impression volume, cost per click, cost per acquisition, conversion rates or return on advertising spend. Advertising spend is paid directly by you to the relevant platform, and you are responsible for the content, claims and offers in your advertising and on your landing pages. Conversion and attribution data reported by advertising and analytics platforms are estimates that may be affected by consent choices, tracking limitations, modeling and attribution settings.
8. Email Marketing
Email deliverability, inbox placement, open rates and click-through rates depend on factors including mailbox provider filtering, sender reputation, authentication settings, list quality, content and recipient behavior. We do not guarantee that emails will be delivered to the inbox or achieve any particular engagement. Open and click metrics may be affected by privacy features of email clients and may not be accurate. You are responsible for ensuring that your contact lists were collected lawfully and that recipients have given any consent required by law.
9. Web Development
Websites depend on hosting environments, content management systems, plugins, themes, browsers, devices and third-party services that change over time. We do not guarantee that a website will be compatible with all browsers and devices, remain free of errors or security vulnerabilities, or continue to function without maintenance after updates to third-party components. Unless expressly included in an Engagement Document, we do not guarantee conformance to any particular accessibility standard, performance score or legal requirement applicable to your website content.
10. Analytics, Reporting and Automation
Reports, dashboards and analyses we provide are based on data from third-party tools and platforms, which may be sampled, modeled, delayed, incomplete or affected by ad blockers, consent choices and tracking limitations. Reports are intended to support business decisions and may not be exact. Automated workflows depend on third-party integrations that may change or fail. You remain responsible for reviewing automated outputs and for decisions made on the basis of reports or automations.
11. Case Studies, Testimonials and Statistics
- Case studies. Case studies on our Websites describe work performed for specific clients in specific circumstances, including their industry, competition, budget, starting position and timing. The results described are not typical and do not guarantee that you will achieve similar results. Where we present performance figures, they are based on data available to us at the time of publication and are not updated unless stated.
- Client names and logos. Client names, logos and project images are displayed with permission or in accordance with our agreements with those clients. Their display does not mean that those clients endorse any other Service or statement.
- Testimonials. Any testimonials or reviews published on our Websites reflect the genuine experience and opinion of the individual client. We do not publish testimonials that we have written or altered in substance, and we disclose any material connection with the reviewer where one exists. Individual experiences are not a guarantee of future results.
- Company statistics. Statements such as the number of years of experience, projects delivered or businesses supported may include the professional experience and work of our founders and team members, including work completed before the formation of Aomark Digital LLC. They are provided as a general description of experience and are not a representation of the age of the Company or a guarantee of quality or results.
12. Forecasts, Estimates and Projections
Any forecasts, estimates, projections, keyword volume data, traffic estimates, budget recommendations or expected timelines provided by us, in proposals, audits, reports, calculators or on our Platforms, are prepared in good faith based on available data and assumptions. They are intended for planning purposes only, are subject to uncertainty and are not guarantees or promises of future performance.
13. Third-Party Metrics and Data
Our Websites, Platforms, reports and placement listings may display metrics provided by independent third parties, such as domain authority, domain rating, estimated organic traffic, keyword difficulty, search volume and backlink counts. These metrics are estimates produced by third-party tools using their own methodologies. They are not official search engine metrics, may differ between tools, change over time and may be inaccurate. We are not responsible for the accuracy of third-party metrics, and changes in these metrics are not a ground for a refund or replacement, except as expressly stated in our Refund and Cancellation Policy.
14. Automated and AI-Generated Output
Some features of our Platforms and some of our Services use automated tools, including third-party artificial intelligence and language processing services. Automatically generated content, suggestions and recommendations may be inaccurate, incomplete, outdated, biased, similar to content generated for others, or unsuitable for your purpose. They do not constitute professional advice. You are responsible for reviewing, fact-checking, editing and approving all Output before publication or use, and for ensuring that it complies with applicable law, third-party rights and search engine and platform policies. We do not guarantee how search engines or other platforms will treat automatically generated content.
15. Software and WordPress Plugins
Our free WordPress plugins and other Software are provided “as is,” without warranty of any kind and without guaranteed support or updates, as described in our Software License Notice. Before installing or updating any plugin, you should back up your website and test the plugin in a staging environment. We are not responsible for data loss, conflicts with other plugins, themes or hosting configurations, security issues arising from outdated installations, or changes made to your website through the use of the Software.
16. Third-Party Links, Content and Services
Our Websites, Platforms and content may contain links to, or references to, third-party websites, tools, platforms, products and services. These links and references are provided for convenience and information only. We do not control, endorse or assume responsibility for the content, accuracy, privacy practices, security, availability or terms of any third party. Your use of third-party websites and services is at your own risk and subject to their terms and policies.
Where our content includes affiliate links, sponsored content or any other material connection with a third party, we will disclose that connection clearly and close to the relevant content, in accordance with applicable advertising disclosure rules.
17. Trademarks and No Affiliation
Google, Google Ads, Google Analytics, Google Search Console, Meta, Facebook, Instagram, WordPress, WooCommerce, Stripe and other product and company names mentioned on our Websites or in our content are trademarks or registered trademarks of their respective owners. They are used for identification and descriptive purposes only. Unless expressly stated, Aomark Digital is not affiliated with, endorsed by, sponsored by or certified by any of these companies, and any reference to them does not imply such a relationship.
18. Errors, Omissions and Availability
Our Websites and Platforms may contain typographical errors, inaccuracies or omissions, including in descriptions of Services, features, pricing and availability. We reserve the right to correct any errors and to change or update information at any time without prior notice. If a price is displayed incorrectly, we are not obliged to provide Services at the incorrect price, and we will inform you and give you the option to proceed at the correct price or cancel with a full refund of any amount paid. We do not guarantee that our Websites or Platforms will be available at all times, uninterrupted, secure or free of errors, viruses or other harmful components.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AOMARK DIGITAL AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE, WHETHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE, ARISING OUT OF OR RELATING TO YOUR USE OF, OR RELIANCE ON, THE CONTENT OF OUR WEBSITES, INCLUDING ANY LOSS OF PROFITS, REVENUE, DATA, RANKINGS, TRAFFIC OR BUSINESS OPPORTUNITY.
Our liability in connection with the Services, Platforms and Software is governed by the limitation of liability provisions of our Terms of Service and Platform Terms of Use. Nothing in this Disclaimer excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, willful misconduct or, where applicable, death or personal injury caused by negligence, or the mandatory rights of Consumers.
20. Your Responsibility
You are responsible for evaluating whether our Services, Platforms, Software and content are appropriate for your business, for making your own business decisions, for the legality and accuracy of your products, services, websites, content and advertising, and for obtaining independent professional advice where needed.
